In September 2010, Kim So-yeong, a second year middle school student who asked to use an alias, was dragged into an alley by eight students who said they were in a “bad mood” and proceeded to hit Kim for an hour. One of the students was Kim’s schoolmate at a Gyeonggi middle school.
It was just the beginning of Kim’s long ordeal.
The eight students then took Kim to a closed-down PC room and pinned her arms so that she could not move, beat her with an empty overturned plastic water jug and burned her lips, tongue and arms with a cigarette.
Every time Kim screamed, she was burned with a cigarette. Her assailants called over older high school boys and made them join in on beating Kim and spit on her face.
Five hours later, Kim, who has suffered from epilepsy since childhood, had a seizure, but the bullies left her and she eventually lost consciousness. She was later discovered and transferred to a hospital.
Kim, now 16, recalls being assaulted on some 90 different occasions over four months beginning in May 2010. The beatings were conducted in the school hallways, underneath the neighborhood bridge and elsewhere.
Because she was concerned that her father would worry about her, Kim had not let on about the anguish that she had endured from the bullies until that final incident in the fall.
Kim’s father, 42, filed suit against the students and school for her suffering.
A year and three months later, on Dec. 26, the court ruled on the case.
Although the court ordered two of the eight students that assaulted Kim that September to pay a fine of 33 million won, it did not recognize the fault of the school. The father had settled out of court with the other students.
The court stated in its ruling, “It is difficult to find evidence the plaintiff was assaulted in school or that the teachers or principal could have predicted this.”
According to the court, since the September incident occurred on a Sunday, it is difficult to hold the school principal or teachers responsible.
As a result of the court case, Kim has thus far received compensation of 12 million won. But because of the cost of the lawsuit and her treatment, her father is on the brink of having to sell his barber shop.
Kim’s father said in an interview at his barber shop on Friday, “Instead of monetary compensation, I just want to see the school take responsibility instead of avoiding it.”
He added quietly, “Though I don’t know much about the law, I wish the school could have said just one word of genuine apology.”
Kim has suffered from epilepsy since she was three years old. Because of her condition, it hasn’t been easy for her to hang out with her peers and she has to take medication constantly. Since her parents divorced, she has been living with her father, grandmother and younger sibling.
Her father says he would fight the Provincial Office of Education, under which his daughter’s school falls, but his financial situation prevents him from doing so.
He said his only solace is that his daughter will leave middle school and enter high school come spring.
Kim and her family went to a New Year’s Day church service, and as she came out of the church, her face held few traces of the dreadful ordeal she had to endure.
Her father said, “I hope my daughter is less sick and healthier in the New Year. I pray to God that the violence at the school will disappear.”

학교서 “미안하다” 말 한마디라도 했으면…
집단 폭행 피해 … 중학교 2학년 소영양 부녀의 새해 소망
2010년 9월 경기도의 한 중학교 2학년생이던 김소영(가명)양은 귀갓길에 8명의 학생에게 끌려가 집단구타를 당했다. 그중엔 소영이가 다니는 학교 학생도 있었다. 가해 학생들은 “기분이 꿀꿀하다(좋지 않다)”며 한 시간 동안 소영이를 때렸다. 이어 폐업한 PC방으로 소영이를 데려갔다. 팔을 붙들어 꼼짝 못하게 한 뒤 빈 생수통으로 때리고 담뱃불로 입술과 혓바닥, 팔을 지지기까지 했다. 비명을 지를 때마다 ‘담뱃불 고문’이 이어졌다. 이들은 전화로 ‘고등학생 오빠’들을 불러내 소영이를 때리게 하고 얼굴에 침을 뱉기도 했다. 간질을 앓고 있던 소영이가 발작을 일으켰지만 아이들은 아랑곳하지 않았다. 5시간에 걸친 폭행 끝에 소영이는 정신을 잃었다. 폐업한 줄 모르고 PC방에 들어온 손님이 소영이를 발견해 경찰에 신고하면서 병원으로 옮겨졌다.
‘아빠가 걱정할까 봐’ 한 번도 내색을 하지 않았던 소영이는 이 사건이 있고 나서야 그동안의 고통을 털어놨다. 소영이가 기억하는 폭행당한 횟수는 90여 차례. 그해 5월부터 4개월 넘게 계속됐다고 한다. 학교 복도나 으슥한 곳은 물론 동네 다리 밑에서도 집단구타가 행해졌다는 것이었다.
그로부터 1년3개월이 흐른 지난해 12월 26일. 소영이 아버지 김모(42)씨는 법원으로부터 판결문 한 통을 송달받았다. 가해 학생과 학교(도교육청)를 상대로 낸 손해배상 청구소송의 결과였다. 판결문 내용은 실망스러웠다. 법원은 가해 학생 8명 가운데 합의를 거부한 2명에게 모두 3300만원의 손해배상 책임을 인정했지만 학교 책임은 인정하지 않았다. 재판부는 “원고가 학교 안에서 지속적인 폭행을 당했다는 사실이나 교장·교사가 이를 예측 가능한 상태에 있었다는 사실을 인정하기 어렵고, 사건 자체가 일요일 학교 밖에서 일어나 학교 교장이나 교사에게 보호·감독의무 위반의 책임을 지우기는 어렵다”고 했다.
지금까지 김씨가 합의금 조로 받은 돈은 1200만원에 불과하다. 그나마 지금까지 들어간 소송 비용과 치료비가 많이 들어 운영 중인 이발소마저 처분해야 할 형편이다.
12월 30일 이발소에서 만난 김씨는 “금전적 보상보다 학교가 책임지는 자세를 보이길 바랐는데 책임 회피에만 급급했다”며 “내가 법은 잘 모르지만 학교가 진심으로 사과 한마디라도 했으면 좋았을 텐데…”라며 말끝을 흐렸다. 소영이는 3세 때부터 간질을 앓았다. 몸이 약해 또래들과는 잘 어울리지 않았다. 어려서 부모가 이혼한 탓에 아버지와 할머니, 두 살 어린 동생과 지냈다. 넉넉지 않은 형편에 약을 입에 달고 살아야 했지만 밝고 고운 마음씨를 가진 아이로 자랐다.
김씨는 항소를 포기한 상태다. 마음 같아서는 학교 지도 책임이 있는 도교육청을 상대로 싸워 보고 싶지만 형편이 여의치 않아서란다. 소영이가 새해에는 중학교를 졸업하고 고등학교에 진학하는 게 그나마 위안이 된다고 했다.
김씨 부녀는 새해 첫날인 1일 새벽 교회에 가서 첫 예배를 드렸다. 예배를 마치고 나오는 해맑은 소영이의 얼굴에서 끔찍했던 기억을 찾기는 어려웠다. 소영이는 “내 꿈은 커서 아빠 같은 헤어디자이너가 되는 것”이라고 했다. 김씨는 “새해에는 딸아이가 덜 아프고 건강했으면 좋겠다”며 “하나님께 학교폭력이 사라지게 해 달라고 기도했다”고 말했다.
아직 동 트지 않은 추운 새벽. 소영이네 6평짜리 이발소는 세상에서 가장 밝고 따뜻한 곳 중의 하나였다.
